Welcome to Fast Trade Technologies Pvt Ltd (“Fast Trade Technologies”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) apply to your use of our websites, web and mobile applications, software products (including FTT-DMS, FTT-Lens, FTT-MIS, Eventin, FTT-QR Tracker and FTT-ChatBot), reports and related online services (collectively, the “Services”).

By visiting our site, providing your information to our team, or signing up / logging in to any of our products, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with these Terms, please do not use the Services.

Eligibility

Our Services are not intended for children under 18. By using the Services, you confirm that you are at least 18 years of age and are legally capable of entering into a binding contract. If you use the Services on behalf of a company or organization, you confirm that you are authorized to accept these Terms on its behalf.

Accounts and Access

• You must provide accurate, current and complete information when signing up for or using any of our products.
• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

• We may suspend or terminate access to accounts that violate these Terms or are used for fraud, abuse or security incidents.

Acceptable Use

When using the Services, you agree not to:

• Use the Services for any unlawful, fraudulent or harmful purpose.
• Attempt to gain unauthorized access to our systems, servers, networks or other users’ accounts.
• Upload or transmit viruses, malware or any code designed to disrupt or damage the Services.
• Copy, modify, reverse engineer, resell or redistribute any part of the Services without our written permission.

• Provide false, misleading or incomplete information to us or through the Services.

Services, Reports and Delivery

We provide software development, business process automation, SaaS products and customized reports. We do not ship physical goods; reports and digital deliverables are made available through our secure online portal or by email, as described in our Shipping Policy.

The accuracy of any report or output depends on the information you provide. You are responsible for ensuring that the data and inputs you submit are correct and complete. We are not responsible for errors resulting from incorrect or incomplete information provided by you.

Fees, Payments and Subscriptions

• Pricing and Quotations: Pricing for our software products, subscriptions, reports, and custom development services is determined based on the customer's specific requirements, intended usage, number of users, selected features, and scope of work, as applicable.
• Payments may be processed through trusted third-party payment processors, and you agree to comply with their terms.
• Unless stated otherwise, all fees are exclusive of applicable taxes, which will be charged as required by law.
• We may suspend access to paid Services if payments are overdue.

Cancellations and Refunds

Refunds are only considered in the limited circumstances described in our Refund Policy, such as duplicate payments, significant report errors or non-delivery of service. In the case of FTT-MIS, no refunds are available once the subscription is made. Please review the Refund Policy before making a purchase.

Mobile Applications

Some of our mobile apps may request permissions such as physical activity, location (foreground and background) and background activity in order to provide features like step counting, distance calculation and continuous tracking. These permissions are requested only where necessary for the app’s functionality. You can grant or revoke them at any time through your device settings; however, disabling them may limit certain features. How we handle this data is described in the Mobile App Step Count Privacy Policy.

Your Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains what information we collect, how we use and share it, and how we protect it. You retain ownership of the data you submit to the Services, and you grant us the rights necessary to process that data in order to provide, operate and improve the Services.

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Fast Trade Technologies shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount you paid to us for the specific Service giving rise to the claim during the three (3) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Fast Trade Technologies, its directors, employees and partners from any claims, losses or damages arising from your misuse of the Services, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if required by law. You may stop using the Services at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and indemnification, will continue to apply.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan, India.

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
